These terms form a legal agreement between you and ePayLoan, regulating your usage of the ePayLoan website, including all its pages, and, unless overridden by any contracts signed with you, any products or services we provide.

If you apply for a loan, you'll need to agree to these rules too.

Eligibility

Our website's products and services are only for adults who are legally allowed to use them in Canada. You need to be 18 or 19 years old, depending on where you live. Also, you must be a resident of British Columbia, Alberta, New Brunswick, Saskatchewan, Ontario, Nova Scotia, Manitoba, or Prince Edward Island to use our website.

Emails

We keep all conversations between you and ePayLoan private and only for our use. It's really important not to share or misuse any information from our emails. It's against the rules to collect email addresses from ePayLoan using automated tools. Also, sending any unwanted ads or promotions to people using our website is not allowed. If you want to talk about business with ePayLoan, please email us at info@epayloan.ca.

Intellectual Property Rights

The website and everything on it, like information, pictures, and videos, belong to ePayLoan. You can use the website for yourself, but not for making money. You can't copy, change, or share anything from the website unless:

  • You're just temporarily storing it on your computer's memory,
  • Your web browser automatically saves files to make the website work better, or
  • You're printing a few pages for your own use.

  • Do anything that could damage or disrupt the website.
  • Use any tools or software to access or copy stuff from the website without permission.
  • Use any viruses or harmful software on the website.
  • Try to access parts of the website you're not supposed to or mess with the website's servers.
  • Attack the website or try to shut it down.
  • Mess with the website's normal operation in any other way.

Website Access and Account Security

To get into the special parts of ePayLoan's website just for people with accounts, you'll need to use the username and password you made. It's really important not to use someone else's username and password to see stuff on the website that's meant to be private.

You're in charge of keeping your username and password safe. That means you need to control who can get into your account, keep your login details secret, and tell ePayLoan if you need to stop using your username for safety reasons. Always remember to log out when you're done, especially if you're using a computer that other people can use, so your personal info stays safe.

If someone gets your username or password without your okay, tell ePayLoan right away. Until you do, you're responsible if someone else uses your account without permission.

Resolving Disputes

If there's a disagreement about these Terms or the website, we'll solve it through arbitration. This means a neutral person will hear both sides and make a decision. But, if we need to protect ePayLoan's confidential info or intellectual property, we might go to court instead.

Each disagreement will be handled separately, and we'll meet in Ontario for the arbitration. During this process, everything shared will be kept private. We won't share any details without permission.

You'll need to pay for your own legal help during arbitration.

Whatever the arbitrator decides will be final, like a judge's decision. We won't be able to go to court afterward to challenge it.

Responsibility for Losses

You agree to protect, compensate, and release ePayLoan and its subsidiary websites, as well as their officers, directors, employees, agents, licensors, and suppliers, from any claims, actions, demands, liabilities, and settlements, including reasonable legal and accounting fees, that arise from or are alleged to arise from your violation of these Terms and Conditions of Use.

Violations of these Terms of Use

Violations of these Terms and Conditions of Use will result in the following actions:

  • You will receive a formal warning.
  • Your access will be suspended.
  • Your computer's access to the Website will be blocked using your IP address.
  • We will contact your Internet provider to block your access to the Website.
  • Legal action may be taken in court for breaches of contract.
  • Any content you have generated may be permanently deleted or blocked.

Links

The website may have links to other sites run by different companies, not connected to ePayLoan and its related sites. ePayLoan and its related sites aren't responsible for anything on those other sites - like info, stuff to read, things to buy, or services offered. Just because we link to another site doesn't mean we're saying their stuff is good. We're not in charge of any problems you might have with things you buy or services you use from those other sites. Those other sites might have different rules about privacy and keeping your info safe compared to us.

Governing Law

These Terms and Conditions of Use are governed by the laws of the Province of Ontario, Canada. If any law conflicts with any part of these Terms and Conditions, those parts will be adjusted to follow the law. The rest of the terms will stay the same.

Cashback Program:

The Cashback program, devised by ePayLoan, is specifically crafted to offer advantages to our clientele. It's important to note that we retain the discretion to modify or discontinue the program in the future without prior notification. Below, you'll find the program's specifics:

Silver:

  • Earn 7% of the cost of borrowing that will be deposited in your wallet.
  • Eligible from the 1st Loan itself
  • For the first nine loans, you will be classified as a silver member. Upon reaching the 10th loan and maintaining good standing, you will be promoted to gold membership.
  • The 10th loan will be interest-free if all previous loans are paid on time. The interest free loan is eligible only up to $300 loan amount.
  • Check the Terms and Conditions for other requirements.

Gold:

  • Earn 14% of the cost of borrowing that will be deposited in your wallet.
  • Eligible from the 11th Loan itself as the 10th Loan will be interest-free.
  • After being promoted to Gold membership, for the first nine loans, you will maintain your Gold member status. Upon reaching the 20th loan and maintaining good standing, you will be further promoted to Platinum membership.
  • The 20th loan will be interest-free if all previous loans are paid on time. The interest free loan is eligible only up to $500 loan amount.
  • During Gold membership status, if you miss a payment or fail to pay an installment on time, you will be demoted to silver membership, and your membership progression will reset from the beginning.
  • Check the Terms and Conditions for other requirements.

Platinum:

  • Earn 21% of the cost of borrowing that will be deposited in your wallet.
  • Eligible from the 21st Loan itself as the 20th Loan will be interest-free.
  • Upon attaining Platinum status, you will continue to enjoy its benefits as long as you consistently repay your loans on time. Additionally, on your 30th, 40th, and 50th loans, as well as on subsequent loans, you will receive interest-free terms. The interest free loan is eligible only up to $500 loan amount.
  • During Platinum membership status, if you miss a payment or fail to pay an installment on time, you will be demoted to Silver membership, and your membership progression will reset from the beginning.
  • Check the Terms and Conditions for other requirements.

Friend Referal,

  • If you refer a friend, you will receive $20 per referral for the first five referrals, 25$ per referral for the next 5 referrals, and earn up to $50 per referral when he refers at least 35 people.
  • To qualify for the referral bonus, your referred individual must have successfully obtained a loan and repaid it on time, adhering to the original terms and conditions.
  • The loan is deemed as paid once ePayLoan has received the funds in our bank account and the status has been updated to "completed."
  • Once the loan status of your referred individual is changed to "completed," you will receive the referral bonus directly into your wallet.
  • Your earned Cashback and Referral bonus both will be deposited into your wallet. They can be redeemed once the total amount reaches $25 or more and other conditions are met.
  • Check the Terms and Conditions for other requirements.

Conditions to obtain Cashback and Referrals:

  • You must not be undergoing bankruptcy, consumer proposal, or enrolled in a debt consolidation program
  • No current or past loans with ePayLoan should have been written off.
  • Your Loans should have been paid back with original terms and conditions.
  • Your ePayLoan account must not have been flagged for fraudulent activity since its creation.
  • The Cashback remains pending until your loan is fully repaid. Upon full repayment, your Cashback becomes accessible, unless it has expired.
  • Failure to meet Cashback conditions results in nullification of pending Cashback.
  • Any reversal of current or past loan payments disqualifies you from the Cashback program.
  • Alberta and Nova Scotia residents: To qualify for Cashback, you must not have repaid your loan in advance (before the last payment due date of your Loan Agreement)
  • Manitoba and New Brunswick residents: Not eligible for the cashback program.

Conditions to redeem amount from Wallet:

  • To qualify for Cashback, you must fulfill all conditions outlined.
  • Your ePayLoan account must maintain good standing, meaning it has no outstanding balance from the current or previous loans.
  • A minimum of $25 Cashback must be available for redemption.
  • Cashback can be received via e-transfer to your primary ePayLoan email address.
  • Your ePayLoan account must not have been voluntarily closed.
  • ePayLoan retains the right to reject Cashback redemption if any conditions are not met.
  • Participation in the Cashback program is at the discretion of ePayLoan and may be refused or excluded.
  • ePayLoan reserves the right to amend Cashback program rules at any time.
  • The ePayLoan Cashback program may be terminated in any province at any time, as determined by ePayLoan

Cashback and Referrals Expiration:

  • Your Cashback will expire after six (6) months of inactivity in your ePayLoan account, which is defined as no activity for six (6) months following the last payment recorded.
  • The six (6) months will be calculated from the same calendar date of the sixth consecutive month, or if such date doesn't exist, it will end on the last day of that sixth month.
  • Reactivation of your account will occur automatically upon obtaining a new loan with us before the end of the six (6) month period.
  • Once Cashback expires, it becomes unrecoverable, even upon reactivation of your account at a later date.

Other Provisions:

Except where prohibited, the customer and the Referral agree to the following terms regarding the Referral Program:

  • Any disputes, claims, or causes of action arising from the Referral Program will be resolved individually, without resorting to any form of class action, and exclusively in the Province of Ontario.
  • Claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, excluding legal fees.
  • Neither the customer nor the Referral will be entitled to seek compensation for any disputes, claims, or causes of action arising from the Referral Program. Both parties waive all rights to claim indirect, punitive, incidental, consequential damages, or any other damages, except for actual out-of-pocket expenses. Additionally, both parties waive any rights to have damages multiplied or otherwise increased.

All matters concerning the interpretation, validity, construction, and enforceability of the Terms and Conditions, as well as the rights and obligations of the Ambassador, the Referral, or ePayLoan in connection with the Referral Program, shall be governed by and construed in accordance with the laws of the Province of Ontario.
